1. Acceptance of Terms

By using this website, submitting an inquiry, creating an account, or placing an order, you agree to these Terms & Conditions and our related policies. If you do not agree, please do not use the site or complete a purchase.

2. Products and Availability

We offer original artworks, prints, and custom or commissioned pieces. Originals are unique and subject to availability. Prints and commissioned works may have separate production timelines, specifications, and approval steps.

We reserve the right to correct listing errors, pricing errors, image errors, stock errors, or technical issues, and we may decline or cancel an order if an item is unavailable or was listed incorrectly.

3. Pricing, Currency, and Taxes

Our internal base pricing is maintained in INR. For supported international checkout flows, prices may be displayed and charged in another currency using exchange rates available to us at the time of checkout.

Displayed exchange-based prices are estimates until checkout is finalized. Payment gateway rules, currency rounding, minimum payable amounts, destination taxes, VAT, duties, customs charges, and shipping charges may affect the final amount charged.

Customers are responsible for any import duties, customs fees, brokerage charges, local taxes, or similar destination-country charges unless we explicitly state otherwise.

4. Payments

Payments are processed through third-party payment partners such as Razorpay. We do not store your full card number, CVV, or banking credentials on our servers.

We may refuse, delay, or cancel an order if we detect failed authorization, fraud risk, duplicate payment attempts, technical mismatch, or suspected misuse of discount codes, checkout flows, or payment instruments.

5. Order Confirmation and Cancellations

An order is confirmed only after successful payment authorization and acceptance by the studio. We may contact you if any shipping, personalization, stock, or verification issue requires clarification before dispatch.

Customers may cancel an order only while its order status remains placed. Once an order moves beyond the placed stage, customer cancellation is no longer available through the website.

If an eligible order is cancelled while its status is placed, we issue a full refund against the amount paid for that order. Refund settlement timing depends on the payment provider and banking channels.

6. Shipping and Delivery

Shipping timelines are estimates and may vary by destination, courier partner, customs review, weather conditions, and other events outside our control. Risk of transit delay with third-party carriers cannot be fully eliminated.

7. Color, Image, and Display Variations

We aim to represent each artwork as accurately as possible. However, variations may occur because of photography, lighting, framing, texture, screen calibration, monitor settings, and print reproduction processes.

8. Intellectual Property

Unless expressly stated otherwise, all artwork images, text, branding, website content, and related creative materials remain the intellectual property of Mishal Jethva. Purchase of a physical artwork does not transfer copyright, reproduction rights, licensing rights, or commercial usage rights.

You may not reproduce, publish, sell, license, scan, mint, commercially exploit, or distribute artwork images or derivatives without prior written consent.

9. Accounts and Acceptable Use

You are responsible for maintaining the accuracy of your account and shipping details. You agree not to misuse the site, interfere with checkout or authentication flows, attempt unauthorized access, or submit false payment, shipping, or identity information.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses arising from use of the site, shipment delay, customs delay, third-party payment failure, courier issues, or events outside our reasonable control.

Nothing in these Terms limits rights that cannot legally be excluded under applicable law.

11. Governing Law

These Terms are governed by the laws of India. Any dispute relating to the website or studio transactions will be subject to the competent courts having jurisdiction in India, unless mandatory consumer law in your place of residence requires otherwise.
